Rosenthal: New Sears boss hopes to be a new kind of merchant








He's been a big-time investor in the retail sector for more than 15 years and was chairman of Kmart after it emerged from bankruptcy about a decade ago. A few years later, he paired it with once-dominant Sears.


Yet even as Eddie Lampert is poised next month to add the role of chief executive to that of chairman at retail giant Sears Holdings, he's still characterized generally as just a hedge fund guy.


This, Lampert suggested in a rare interview Tuesday, fails to acknowledge changes in the 21st century retail industry as well as the Hoffman Estates-based company he seeks to revive.






"The most successful guy in retail right now is Jeff Bezos, and he was a (Wall Street) hedge fund guy," Lampert, 50, said by phone. "I think a lot of times when people talk about merchants it's almost a nostalgic look back at the time where the world moved at a very different pace and information was very different."


Lampert has decided to succeed Lou D'Ambrosio, who is leaving to tend to a family health issue. Critics complain that this is just the latest missed opportunity to have a world-class merchandiser run the struggling company.


"So it's Eddie Lampert who's going to be there, and he's a smart guy and insightful when it comes to doing deals, but he doesn't have a track record at running a retail operation," said Evan Mann, an analyst with Gimme Credit.


Lampert argues that a new kind of sales, one that encompasses e-commerce, traditional bricks-and-mortar, mobile and more, requires a new kind of merchant.


"Trying to move the volume of products we're talking about from place to place to get it ultimately into the customer's hands, to price these items, to market these items, I think the retail business is incredibly complex," Lampert said. "But if you get it right, it's a beautiful thing."


"I'm not denying that there are still great merchants," he said. "But to operate a company of the size of Sears Holdings or Wal-Mart or Target or Home Depot or Lowe's, you need a combination of skills, and each of those skills needs to be sufficiently strong."


Lampert can make the case that he is a modern-day merchant. He still hasn't proved he's a good one. For six successive years, Sears Holdings has seen no top-line growth, due to slipping sales and store closings.


"I understand and I appreciate people looking at same-store sales as an indicator," D'Ambrosio said during the call. "I think when you look at the financial shape of the company, there's clear progress."


D'Ambrosio noted four consecutive quarters of EBITDA growth and the fact the company raised $1.8 billion of liquidity in 2012 while reducing net debt by $400 million.


Overshadowed in Monday's news of the leadership change were other glimmers of hope: Sears' domestic comparable-store sales for the nine weeks ended Dec. 29 were up 0.5 percent.


Meanwhile, the strategy of technological convergence, which included a loyalty program, has yielded a wellspring of consumer data and changed customers' relationship with the retailer. Kmart and U.S. Sears' online sales are up 20 percent.


"It's never a good time for a transition, but what I would tell you is, five years ago, we put in place a more distributed leadership structure," Lampert said. "Despite what people may have said or written, there is a difference between a chairman role and a CEO role, and I've never been in the CEO role in this company."


D'Ambrosio predicted Lampert will offer strategic continuity. But handicappers have long questioned whether the old horse had any giddy-up left in its step to catch up to and keep pace with Wal-Mart, Target and Amazon.


And not to beat a dead metaphor, but the suspicion among many all along has been that Lampert saw neither a thoroughbred nor tireless workhorse in the parent of Sears and Kmart as so many parts to be cut up, boiled down and sold off.


"I was very clear why we put these companies together and what our goals were," Lampert said. "It was really to allow both Sears and Kmart to compete in what I thought was going to be a more challenging but evolving industry. The framework which was placed upon me and the company was: 'OK, this was all about real estate. It's about selling real estate.' Then when we didn't sell real estate, it became: 'Well, they missed the opportunity in 2006, 2007 to sell the real estate.'


"I've never denied there was substantial real estate value in the company," he said. "Suffice it to say that … the most value can be created if we actually transform it."


Fortune in 2006 called Lampert "the best investor of his generation." A Forbes contributor last year ranked him No. 2 on a list of the worst CEOs, and while acknowledging Lampert was Sears Holdings' chairman and not CEO, the contributor argued that "Lampert has called the shots, he's missed every target" and that he had "destroyed Sears."


D'Ambrosio said he doesn't recognize the Lampert he sometimes sees described by critics.


"I've never worked with somebody who understands business models and how to re-imagine a business model and has a view on the way buying will change going forward better than Eddie," D'Ambrosio said.


It turns out, his image is the thing he's least interested in selling at Sears Holdings.


"I do think what we've been trying to do at the company has been very clear," Lampert said. "If people want to doubt it or put a spin on it, they're entitled to do it. We just have to perform."

This isn’t just the stuff of legitimate Twitter news-breakers like Anthony DeRosa and Andy Carvin — Ohman provides a helpful breakdown of the terms she looked for — you know, like “social media warrior.” (We’re tempted to argue that such diligence makes Ochman something of a social media warrior herself.) Ochman also warns of using “guru” — a Sanskrit term — to describe oneself:



While a great many of these self-appointed gurus are no doubt taking the title with tongue firmly planted in cheek, the fact remains: a guru is something someone else calls you, not something you call yourself. Scratch that: let’s save “guru” (Sanskrit for “teacher”) for religious figures or at least people with real unique knowledge.


I’d argue, in fact, that “social media” and “guru” should never appear in the same sentence.



Whatever the term, social media seems to be a growth industry: there were only 15,740 “mavens” (or whatever) in 2009 — less than a tenth of those represented today.

Starz signs first-look deal with former legendary TV head Jeremy Elice






LOS ANGELES (TheWrap.com) – Jeremy Elice, the former head of Legendary Picturestelevision division, has landed at Starz with a new deal, a spokesman for the cable network told TheWrap on Monday.


Under the two-year agreement, Starz will have first-look rights at projects from Elice‘s new company, Elice Island Entertainment.






In addition to his stint at Legendary, Elice was also a development executive at AMC, where he was instrumental in bringing the hits “Breaking Bad” and “The Walking Dead” to the network.

Global Update: China Moves to Prevent Spread of Yellow Fever From Africa





In a move that underlines how many Chinese citizens now work in Africa, China’s quarantine officials recently urged greater efforts to make sure that a yellow fever epidemic now raging in Sudan does not come back to China.




Local health authorities were asked to scan all travelers arriving from Sudan for fevers. Chinese citizens planning travel to Sudan were advised to get yellow fever shots. Customs officers were told that containers arriving from Sudan might have stray infected mosquitoes inside.


Sudan’s epidemic is considered the world’s worst in 20 years. Sweden, Britain and other donors have paid for vaccinations. The United States Navy’s laboratory in Egypt has helped with diagnoses.


Estimates of the number of Chinese working in Africa, many in the oil and mining industries or on major construction projects, range from 500,000 to 1 million. Experts on AIDS have previously warned that the workers could become a new means of bringing that disease to China, which has a low H.I.V.-infection rate.


ProMED-mail, a Web site that follows emerging diseases, has tracked reports about the Sudan outbreak, with its moderators adding valuable context. China’s mosquito-killing winters make a large yellow fever outbreak there unlikely, moderators said. But Sudan’s containment efforts are troubled. For example, vaccinated people cannot get cards proving they have had shots, but the cards are reported to be for sale at police checkpoints.


Australia’s now-endemic dengue fever, according to ProMED moderators, may have come from mosquitoes arriving in containers from East Timor.

Sears CEO D'Ambrosio to step down









Sears Holdings Corp. said Monday night that Chief Executive Officer Louis D'Ambrosio will step down Feb. 2, due to family health matters, and Chairman Edward Lampert will add the role of CEO.


The surprise move fuels uncertainty at the Hoffman Estates-based company, which has struggled for years to re-establish itself as a department store in an ultracompetitive retailing industry dominated by low-price giant Wal-Mart and big box and specialty stores.


The decision by Lampert, a hedge fund operator who is the company's biggest shareholder, to take over day-to-day control represents a reversal from his naming of D'Ambrosio as chief executive nearly two years ago after operating with an interim CEO.





"In light of Lou's decision to step down, the board feels it is important that there is continuity of leadership during this important period of transformation and improvement at Sears Holdings," Lampert said in a statement. "I have agreed to assume these additional responsibilities in order to continue the company's recovery and sustain the momentum we are experiencing, as well as further the development of the management team under the distributed leadership model, which provides our business unit leaders with greater control, authority and autonomy."


Sears Holdings, which operates Sears and Kmart, also updated its fourth-quarter earnings outlook Monday night. The company said it expects to report a net loss $280 million to $360 million, or $2.64 to $3.40 per diluted share, for the quarter ending Feb. 2. The loss includes a charge of about $450 million because of pension settlements and an additional $42 million in pension expenses.


Excluding pension expenses, Sears said it expects to earn $132 million to $212 million, or $1.25 to $2 per share.


Analysts polled by Bloomberg had been expecting adjusted net income of about $137 million.


For the fiscal year, Sears said it expects to lose $721 million to $801 million, or $6.80 to $7.56 per diluted share, which includes pension-related costs and other adjustments reported late last year. Excluding those items, the company said it expects to lose $123 million to $203 million, or $1.16 to $1.92 per share.


D'Ambrosio became CEO after working for the company as a consultant. The 16-year veteran of IBM Corp. had been CEO of a telecommunications company before joining Sears.


"I have worked very closely with Eddie over the past two years. I can say this: there is simply no one in the world that cares more about Sears Holdings and has thought more deeply about our company than Eddie," D'Ambrosio wrote to employees.


Lampert gained control of Sears in 2005 after engineering the merger between Kmart and Sears Roebuck & Co. For years, speculation about Lampert's intentions for the company focused on the value of its real estate, but under D'Ambrosio, Sears appeared to pay more attention to retail aspirations.


The company reported improved performance — it beat Wall Street expectations — in the previous quarter, but Sears stock has lost more than 35 percent of its value since November, closing Monday at $42.92, up 1.7 percent.

A screwdriver-wielding parolee was tackled by two good Samaritans after he stole a woman's purse in the Lincoln Park neighborhood Saturday night, police said.


About 11:45 p.m., Jose Rodriguez, 30, approached a woman from behind in the 800 block of West Diversey Parkway, the Chicago Police Department said in a news release. 


Rodriguez held an arm around the 29-year-old woman's neck, placed a screwdriver against her torso, and demanded money, police said.





Rodgriguez ran off with the woman's purse shortly after, police said.


A 20-year-old witness took off in pursuit, and when Rodriguez approached a 24-year-old man walking in the opposite direction, the 20-year-old yelled for him to stop the robber, police said.


Together, the men tackled Rodriguez and restrained him until police showed up, police said.


Rodriguez was arrested and charged with armed robbery with a dangerous weapon and a parole violation.

“Ubuntu for Phones” Turns Smartphones into Desktop PCs






Millions of people have tried out Ubuntu, a free operating system for desktop and notebook PCs. Like Android, Ubuntu is open-source and based on Linux, and while it’s mostly seen as an OS for hobbyists here in the U.S., hardware manufacturers like Dell and HP make Ubuntu PCs for markets like mainland China.


Now Canonical, the startup which drives Ubuntu’s partly community-based development, has announced a version of Ubuntu that’s made for smartphones. The company previously showed off an experimental version of desktop Ubuntu that hobbyists could install on their Nexus 7 tablets. But the version Canonical demoed Wednesday was tailor-made for smartphones.






What makes Ubuntu different?


The smartphone version of Ubuntu bears little resemblance to the desktop version, aside from its graphical style. Its interface is based around gestures and swipes; instead of a back button, for instance, you swipe from the right-hand edge of the screen to return to a previous app. Swiping up from the bottom, meanwhile, reveals an app’s menu, which remains off-screen until then.


Tech expect John Gruber was critical of the Ubuntu phone interface, noting that “gestures are the touchscreen equivalent of keyboard shortcuts” because they need to be explained to someone before they can use them. The Ubuntu phone site itself calls the experience “immersive,” because it allows more room for the apps themselves.


What will Ubuntu fans recognize?


First, the apps. The same Ubuntu apps which are currently available in the Software Center (Ubuntu’s equivalent of the App Store) will run on an Ubuntu phone, provided the developers write new screens designed for phones — much less work than writing a new app from scratch. Ubuntu web apps, already integrated into its version of Firefox, will also work in the phone version.


Second, the dash and the app launcher. Ubuntu’s universal search feature is easily accessible, and swiping in partway from the left edge of the screen reveals the familiar row of app icons.


What unique features does it have over other smartphone OSes?


Besides the gesture-based design, higher-end Ubuntu smartphones will be able to plug into an HDTV or monitor, and become a complete Ubuntu desktop PC. Just add a keyboard and mouse. This feature was originally announced for Android smartphones (using advertising which insults grandmothers), and Android phones featuring Ubuntu are expected before full Ubuntu phones launch.


When will it be available?


Ubuntu phones (not just Android phones with Ubuntu included) are expected to be on shelves starting in 2014. In a few weeks, however, Canonical will have a version available that you can put on your own Galaxy Nexus smartphone to try it out.

James Earl Jones to star in “Driving Miss Daisy”






SYDNEY (AP) — They’re starring in a play about a woman reluctant to age and the perils of passing time, but veteran actors James Earl Jones and Angela Lansbury say that life in their 80s continues to be exciting thanks to their determination to keep doing what they love.


Jones and Lansbury, in Australia to star in a touring production of Alfred Uhry‘s Pulitzer-Prize winning play “Driving Miss Daisy,” say the thrill of performing has propelled them throughout their decades-long careers and gives them the energy necessary to keep up with their often grueling schedules.






“First of all, wake up. Wake up and try to get your bones moving,” a grinning Jones, who turns 82 this month, said Monday ahead of the cast’s first rehearsal. “And then be enthusiastic about what you do. I’m very enthusiastic about acting still. I love the process of creating a character.”


For 87-year-old Lansbury, whose seven-decade career has spanned stage, film and television, performing live gives her a rush that can’t be matched on the screen.


“You get on stage and you really can let it out,” she said, throwing her arms wide. “You’re not hampered by camera angles or lighting.”


Lansbury, nominated for three Oscars and beloved for her role as amateur detective Jessica Fletcher on the long-running TV series “Murder, She Wrote,” said it was the stage that gave her a jolt of fresh inspiration later in life.


“Coming back to the theater about seven years ago turned the tide for me, it really did. Because it gave me a career after 70,” she said. “I could still work in the theater and play great roles, but it wasn’t so easy to continue as a motion picture actress. Which I was very glad of — I didn’t like the way we were making movies … the kind of roles I would like to play didn’t seem to exist. But I love the theater and, as it turned out, it was the thing to do.”


Both actors jumped at the chance to perform in “Driving Miss Daisy,” which began as an off-Broadway play and inspired the Oscar-winning film starring Jessica Tandy and Morgan Freeman. The play follows the evolving friendship of Daisy and her chauffeur Hoke in the American South over 25 years.


“When I saw Morgan do it, I said ‘I’d like to play that role,’” Jones said. “I thought I understood (Hoke) and I want to understand him more.”


Jones was also attracted to the role because of Hoke’s illiteracy. Jones, famous for his distinctive baritone voice, suffered from a debilitating stutter as a child that left him virtually mute until he was 14. An English teacher mentored him until he discovered his voice, which then led to his acting career. Now, he finds particular fulfillment when playing characters who struggle with language.


Hoke Colburn is such a character. He’s illiterate, but he speaks English … and uses it very effectively and very poetically,” Jones said. “That’s what I love about the role, trying to understand how he re-weaves language so he gets himself across.”


Lansbury said it was the play’s setting in the American South that helped attract her to the role of Daisy.


“I understand the southern mentality,” she said. “I went to drama school with a number of young women who came from (the South) and I never forgot them and I never forgot the way they spoke. Their accents were so interesting to me.”


The role is a big change from her 12-year run as Jessica Fletcher on “Murder, She Wrote,” and the change is welcome. While Lansbury has a soft spot for the mystery writer, she admits she doesn’t miss her much.


“I was happy to retire her. I’m constantly reminded of her by people who are still very fond of watching the show. … I can’t get away from it!” she said with a laugh. “I’m more famous for Jessica Fletcher than anything.”

Alarm in Albuquerque Over Plan to End Methadone for Inmates

Officials at New Mexico’s largest jail want to end its methadone program. Addicts like Penny Strayer hope otherwise.







ALBUQUERQUE — It has been almost four decades since Betty Jo Lopez started using heroin.




Her face gray and wizened well beyond her 59 years, Ms. Lopez would almost certainly still be addicted, if not for the fact that she is locked away in jail, not to mention the cup of pinkish liquid she downs every morning.


“It’s the only thing that allows me to live a normal life,” Ms. Lopez said of the concoction, which contains methadone, a drug used to treat opiate dependence. “These nurses that give it to me, they’re like my guardian angels.”


For the last six years, the Metropolitan Detention Center, New Mexico’s largest jail, has been administering methadone to inmates with drug addictions, one of a small number of jails and prisons around the country that do so.


At this vast complex, sprawled out among the mesas west of downtown Albuquerque, any inmate who was enrolled at a methadone clinic just before being arrested can get the drug behind bars. Pregnant inmates addicted to heroin are also eligible.


Here in New Mexico, which has long been plagued by one of the nation’s worst heroin scourges, there is no shortage of participants — hundreds each year — who have gone through the program.


In November, however, the jail’s warden, Ramon Rustin, said he wanted to stop treating inmates with methadone. Mr. Rustin said the program, which had been costing Bernalillo County about $10,000 a month, was too expensive.


Moreover, Mr. Rustin, a former warden of the Allegheny County Jail in Pennsylvania and a 32-year veteran of corrections work, said he did not believe that the program truly worked.


Of the hundred or so inmates receiving daily methadone doses, he said, there was little evidence of a reduction in recidivism, one of the program’s main selling points.


“My concern is that the courts and other authorities think that jail has become a treatment program, that it has become the community provider,” he said. “But jail is not the answer. Methadone programs belong in the community, not here.”


Mr. Rustin’s public stance has angered many in Albuquerque, where drug addiction has been passed down through generations in impoverished pockets of the city, as it has elsewhere across New Mexico.


Recovery advocates and community members argue that cutting people off from methadone is too dangerous, akin to taking insulin from a diabetic.


The New Mexico office of the Drug Policy Alliance, which promotes an overhaul to drug policy, has implored Mr. Rustin to reconsider his stance, saying in a letter that he did not have the medical expertise to make such a decision.


Last month, the Bernalillo County Commission ordered Mr. Rustin to extend the program, which also relies on about $200,000 in state financing annually, for two months until its results could be studied further.


“Addiction needs to be treated like any other health issue,” said Maggie Hart Stebbins, a county commissioner who supports the program.


“If we can treat addiction at the jail to the point where they stay clean and don’t reoffend, that saves us the cost of reincarcerating that person,” she said.


Hard data, though, is difficult to come by — hence the county’s coming review.


Darren Webb, the director of Recovery Services of New Mexico, a private contractor that runs the methadone program, said inmates were tracked after their release to ensure that they remained enrolled at outside methadone clinics.


While the outcome was never certain, Mr. Webb said, he maintained that providing methadone to inmates would give them a better chance of staying out of jail once they were released. “When they get out, they won’t be committing the same crimes they would if they were using,” he said. “They are functioning adults.”


In a study published in 2009 in The Journal of Substance Abuse Treatment, researchers found that male inmates in Baltimore who were treated with methadone were far more likely to continue their treatment in the community than inmates who received only counseling.


Those who received methadone behind bars were also more likely to be free of opioids and cocaine than those who received only counseling or started methadone treatment after their release.

Blackhawks fans, shops cheer end to NHL lockout









As soon as he heard the Chicago Blackhawks may soon be lacing up to play, Jim Boffa took his family out for a celebratory lunch near the United Center to toast the end of a 113-day NHL lockout.

"I didn't think it was going to happen," the 52-year-old Northbrook man said as he stood beside his wife and three children inside the Palace Grill restaurant on Madison Street.

On Sunday, business owners expressed relief while Blackhawks fans rejoiced after hearing that the NHL and players association reached a tentative deal on a new collective bargaining agreement.

The lockout has knocked the wind out of many establishments in the vicinity of the United Center. Palace Grill lost at least $75,000 over the past few months, owner George Lemperis said. Despite the damage, businesses are grateful that a partial hockey season will be salvaged.

"Any time there's an extra 20,000 people down the street, that's good for everyone," said Matt Doherty, general manager at WestEnd Bar.

At Clark Street Sports, a store that sells Blackhawks and Bulls memorabilia, the lockout's end means more sales and more work for employees, cashier Jose Salazar said.

On nongame days, one or two people might work at the small shop, but as many as five employees are around when professional sports teams play at the arena, he said.

"I'm not a big hockey fan, (but) I'm just excited to get a lot more hours," Salazar said.

Inside Johnny's IceHouse, a hockey rink west of the United Center, some children and adults sported Blackhawks hats, jerseys and T-shirts as they watched 10- and 11-year-old boys play hockey.

Many parents expressed enthusiasm about the end of the work stoppage, but some also said they felt their children lost out over the past few months.

"All these kids look up to the NHL players so much," said Brent Bainter, 39, as he watched his 10-year-old son's hockey team on the ice. "When you don't get a chance to see them play for half a year, it's kind of a bummer."

After the match ended, Alex Lazzerini, 11, who has played hockey since he was 2, said he was nervous the Blackhawks might not play this season.

"Now, I'm hoping to watch them win the Stanley Cup again," he said with a smile.
